Assumption of Risk

The Participant understands and acknowledges that participating in fitness classes, utilizing equipment, and engaging in physical activities at the Studio involve inherent risks. These risks include but are not limited to physical injury, muscle strains, heart attack, or other medical complications.

The Participant affirms that their participation in Studio activities is voluntary and that they assume all risks associated with such activities.

The Participant agrees to follow all Studio rules, instructor guidance, and safety protocols to minimize risk.

Health and Medical Disclaimer

The Participant confirms that they are in good health and have consulted a physician regarding any medical conditions that may impact their ability to safely participate in physical activities.

The Participant agrees to promptly inform Studio staff of any injuries, illnesses, or conditions that may affect their participation.

The Studio and its staff are not medical professionals and do not provide medical advice, diagnosis, or treatment.

Release of Liability

The Participant releases and forever discharges the Studio, its owners, employees, instructors, agents, and affiliates from any and all claims, demands, injuries, actions, suits, pursuits, costs, expenses, damages, and liabilities arising out of or related to participation in Studio activities or presence on the premises, including but not limited to bodily injuries, personal injuries, illness, death, disability, property damages or losses, or other damages of any kind and description incurred as a result thereof, including but not limited to those caused by acts or omissions of the Studio or its trustees, officers, directors, associates, agents, and personnel.

The Participant further agrees for themselves, their heirs, executors, successors, guardians, representatives, administrators, assigns, minor children, and anyone for whom they are a guardian to indemnify and hold harmless the Studio from any and all claims or causes of action arising out of participation in Studio classes or presence on the premises.

In the event of injury, accident, and/or illness during attendance of any class, the Participant authorizes the Studio to summon emergency personnel to attend, transport, and/or treat them as necessary. This includes diagnostic procedures, treatment, and operative procedures rendered under the supervision of licensed professionals. The Participant agrees to bear the full costs of such treatment.

Photo and Video Release

The Participant grants the Studio permission to photograph or record their participation in classes and activities for marketing and promotional purposes.

The Participant irrevocably consents to and grants the Studio, its subsidiaries, affiliates, and designees the unrestricted worldwide right to use, reproduce, distribute, publish, display, transmit, broadcast, and perform publicly the Participant’s name, image, likeness, persona, and/or voice ("Works") in any form, manner, media, or technology now or hereafter known, including but not limited to usage on websites, social media, and promotional materials.

The Participant releases and exempts the Studio, its owners, employees, and agents from any claims involving the use of their likeness, including but not limited to claims for invasion of privacy, violation of right of publicity, moral rights, or defamation.

Participants who do not wish to be photographed or recorded must notify the Studio in writing prior to participating.

Miscellaneous

This Agreement shall be governed by the laws of the State of Ohio.

If any provision of this Agreement is deemed invalid or unenforceable, the remaining provisions shall remain in full force and effect.

This Agreement constitutes the entire understanding between the Participant and the Studio and supersedes any prior agreements.
